Whereas the Ordinary Court of the County of Bartow on the second day of July in the year of eighteen hundred and sixty six, upon the application of R. L. Rogers Executor of the Estate of Robert Rogers late of Bartow County, deceased, did pass an order for the sale of the Real Estate of said deceased, hereinafter described (Legal motion of such application having been given in one of the Public Gazettes of this State for four months, previous to the granting of the order aforesaid) and whereas the said Robert L. Rogers, Executor, having given sixty days notice of said land sale and of the time and place thereof in one of the Public Gazettes of said State, to wit the Cartersville Express and Journal did on the sixth day of November in the year Eighteen hundred and sixty six, at the place of sales in the County of Bartow, expose to sale at public outcry, by virtue of the order aforesaid, the premises hereinafter mentioned; and whereas the said premises were there and then knocked off to Wade H. Wofford, who being the highest bidder for the same, at and for the sum of six thousand six hundred dollars.  Now this indenture, made the seventh day of November in the year Eighteen hundred and sixty six between Robert L. Rogers of the County of Bartow and the State aforesaid, Executor as aforesaid of the one part, and Wade Wofford of the County of Bartow and State aforesaid of the other part, witnesseth that the said Robert L. Rogers Executor as aforesaid, for and in consideration of the sum of six thousand six hundred dollars, in hand paid, at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, hath granted bargained, sold, conveyed unto the said Wade H. Wofford, his heirs and assigns, the following lots and parts of lots, to wit, being lots and parts of lots no (87) Eighty seven, (88) Eighty Eight, (86) Eighty Six, (58) fifty eight, (130) One hundred and thirty, (205) Two Hundred and five, (277) Two hundred and seventy seven, (60) sixty, and (85) Eighty five, being and lying in the fourth District, third section. To have and to hold the said premises with all the rights, appertaining thereto, for the benefit and behoof of the said Wade H. Wofford, his heirs, Executors, assigns, in fee simple. And the said Robert L. Rogers, Executor as aforesaid, his heirs, Executors and Administrators, the said premises, with all the rights and appurtenances appertaining unto the said Wade H. Wofford, his heirs, administrators, executors, assigns against all persons claiming by, from or under the said Robert Rogers, deceased, or the said Robert L. Rogers, Executor as aforesaid but against no other persons whatever, shall and forever warrant and defend, by virtue of these presents.  In witness whereof the said Robert L. Rogers Executor as aforesaid hath hereunto set his hand and affixed his seal, the day and year last above written November 7th 1866.  Signed sealed and delivered in the presence of
